Complete the checklist below for the type of 403(b) plan you need. All checklists are fillable pdfs which are easy to complete and email to us. As soon as we receive it, we will email you a confirmation. We then use the checklist to complete your plan document, summary plan description, and any administrative forms needed to adopt the plan document. Within 1 to 3 business days, we will email your plan document, SPD, and forms to you in both Word and PDF versions.

Our pricing is easy - to create documents on a per-document basis, we charge

$275 for prototype-style 403(b) plans and
$425 for volume submitter-style 403(b) plans.

IRS Guidance:

  • Announcement 2007-102containing corrections to the Final 403(b) Regulations. Announcement 2007-102 was published in the Federal Register on September 25, 2007.

  • Notice 2009-3 extending the deadline contained in the Final 403(b) Regulations to comply with the written plan requirement. The written plan requirement is extended from December 31, 2008 to December 31, 2009. Operational compliance with the Final 403(b) Regulations is not extended by this Notice.

  • Announcement 2009-34 containing the draft Revenue Procedure on the pre-approved 403(b) prototype program, released on April 14, 2009.


Dept. of Labor Guidance:

  • Field Advisory Bulletin 2007-02 addressing how the Final 403(b) Regulations affect the status of plans under the DOL's safe harbor regulation at 29 CFR 2510.3-2(f).

  • Advisory Opinion 94-30a addressing that a non-ERISA plan cannot contain certain provisions, such as in-service distribution or hardship distributions.

IRS Model Plan Document:

  • IRS Revenue Procedure 2007-71 contains (1) model plan language for public school 403(b) plans; and (2) provides transitional relief for contracts or custodial accounts that were issued or exchanged under Rev. Rul. 90-24 before Jan. 1, 2009.
