Michelle, GINA, CHIPRA and MHPAEA – How These Four Acts Recently Amended Cafeteria Plans
In this recording of a previously offered live web seminar conducted on June 25, 2010, we explore the four Acts which recently amended cafeteria plans – the Children’s Health Insurance Program Reauthorization Act of 2009 (CHIPRA), the Genetic Information Nondiscrimination Act (GINA), the Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA), and Michelle’s Law. We discuss the impact on plan documents that each Act made, along with the deadlines to timely adopt amendments for each Act, and the notice requirements for each Act, including the DOL’s Model CHIPRA Notice. This seminar is 60 minutes long and is designed to meet ASPPA’s and NIPA’s requirements for 1 CE credit. We have also applied with the IRS for 1 ERPA CPE credit for this program.

General Outline of This Program:
Brief discussion of the Children’s Health Insurance Program Reauthorization Act of 2009 (CHIPRA), Public Law 111-3, along with it’s impact on plan documents, the deadline to timely adopt a CHIPRA amendment and notice requirements, including the DOL’s Model CHIPRA Notice.
Brief discussion of the Genetic Information Nondiscrimination Act (GINA), Public Law 110-233, signed into law by President Bush on May 21, 2008 and effective for group health plans for May 2009, including amendment deadline and notice requirements.
Brief discussion of the Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA), Public Law , the joint regulations issued on January 29, 2010 by the IRS, DOL and Dept. of Health and Human Services, the amendment deadline and notice requirements, along with which plans MHPAEA applies to.
Brief discussion of Michelle’s Law, Public Law 110-381, signed into law by President Bush on October 9, 2008, including the amendment deadline and notice requirements. Michelle’s Law amended ERISA and the Internal Revenue Code to ensure that dependent students who take a medically necessary leave of absence do not lose health insurance coverage.
